Who is responsible for the sidewalk in front of my house?

In Stockton, the adjacent property owner. Stockton Municipal Code 12.04.040 requires owners to keep the sidewalk in a condition that won't endanger people or property, and the City's Public Works page says the sidewalk, parking strip, curb and gutter next to your property are the owner's responsibility.

There is one important exception: if the damage was caused by a tree maintained by the City, such as a street tree in the parkway, the owner is excused and Public Works handles it. Before paying for a repair, look at what lifted the concrete.

If the City sends you a notice

The code gives owners 10 days after notice to make the repair. If the owner doesn't, the City can do the work and recover the cost as a charge against the property. Getting your own licensed contractor out quickly is usually cheaper and gives you control over the schedule and the finish.

If you think a City tree caused the damage, report it to Stockton Public Works Operations and Maintenance at (209) 937-8341 or through the City's online service request before you hire anyone.

The permit: City of Stockton encroachment permit

Sidewalk, curb, gutter and driveway approach work is in the public right-of-way, so it needs an encroachment permit from the City. The application goes through the City's online Accela permit portal, by email to Engineering, or in person at the Permit Center, along with insurance documents and a traffic or pedestrian control plan. Every contractor and subcontractor on the job needs a City of Stockton business license.

A contractor who does this work regularly will pull the permit, set up the cones and signs, and schedule the City inspection. If a bid doesn't mention the permit, ask.

What sidewalk and curb repair costs in Stockton

Replacing a few sidewalk panels typically runs $10–$18 per square foot, because setup, sawcutting, haul-off and the permit are spread over a small area. Curb and gutter replacement is usually priced per linear foot. Doing several panels at once, or combining the sidewalk with a driveway approach, lowers the cost per foot.

Where tree roots caused the lift, ask for root pruning or a root barrier along with the new concrete; otherwise the same roots lift the new panel in a few years.

Common questions

Does the City of Stockton fix sidewalks?

Only where a City-maintained tree caused the damage. Otherwise the adjacent owner is responsible, and the City can make the repair and charge the property if the owner doesn't.

How long do I have after a sidewalk notice?

The municipal code gives 10 days after notice. Call the City if you need to discuss the timeline, and get a contractor scheduled right away.

Can I do the sidewalk repair myself?

Work in the right-of-way needs an encroachment permit with insurance and a City business license, so most homeowners hire a licensed contractor who handles the permit and inspection.
